Terms & Conditions

Welcome to Simone Marie Studio! These Terms and Conditions apply to all services provided, including Live Event Painting and Commissioned Paintings. By booking a service or placing a commission, you agree to the terms outlined below.
1. Services Offered
Simone Marie Studio provides:
Live Painting Services at weddings and special events, where artwork is created on-site and may be completed in studio after the event.
Commissioned Paintings based on photos, concepts, or other reference material provided by the client.
Each service is customized and outlined in an individual agreement upon booking.
2. Booking and Payment
A non-refundable retainer (typically 25% of the total) is required to reserve a date for live events or to begin a commissioned artwork.
The balance is due according to the timeline in your personal contract (typically one week prior to the event or before the painting is shipped).
Payment details, add-ons (such as expedited shipping, additional figures, or framing), and travel fees (if applicable) are outlined per client agreement.
Note: Our policies may evolve over time. However, the version in your signed agreement will always govern your specific booking or commission.
3. Cancellation and Refunds
Retainers are non-refundable.
For live events: cancellations made at least 12 months in advance may be eligible for a refund or credit toward a future service, at the Artist’s discretion.
For commissions: once work has begun, payments are non-refundable.
If the Artist cancels (due to illness, emergency, or force majeure) before any artwork has been completed, any retainer paid may be refunded or applied as credit toward a future service.
No refunds will be issued after a painting is delivered.
4. Artistic Style and Revisions
The Artist paints in a semi-realistic, impressionist style with gestural backgrounds and a detailed focal point.
Clients are expected to review the portfolio in advance to ensure alignment with this style.
For commissions, one round of minor edits (color tweaks, small adjustments) may be permitted at the Artist’s discretion. Major revisions or restyling requests will not be accommodated.
For live paintings, the final composition is determined collaboratively prior to the event and may be adjusted as needed to suit artistic and logistical needs.
5. Completion and Delivery
For live wedding paintings, final artwork will be delivered within 6 months unless otherwise noted.
For commissions, the timeline will be confirmed during booking and depends on availability and complexity.
Shipping within the U.S. is included unless otherwise noted. International shipping may incur an additional charge.
6. Copyright and Usage
The Artist retains all copyright and reproduction rights to the artwork.
Clients receive ownership of the physical painting, but not digital or commercial rights unless otherwise licensed.
The Artist may display the painting (and progress photos) in their portfolio, on social media, and in promotional materials unless a privacy request is made in writing.
7. Client Responsibilities
For live paintings, the client must coordinate to provide:
A shaded or covered painting area with lighting, table, and chair.
Reasonable access to the venue and timeline for photos or staged reference images if needed.
For commissions, clients must provide high-resolution reference images and any style preferences upfront.
8. Force Majeure
We are not liable for delays, cancellations, or non-performance due to circumstances beyond our control (e.g., illness, natural disasters, venue restrictions, transportation issues, etc.).
9. Updates to Terms
We may update these Terms and Conditions from time to time. Any updates will be reflected here. Your signed agreement will always govern the terms of your specific booking or commission, regardless of subsequent changes.
